I. Highlights of New Laws

Xinhua News Agency Further Regulated Foreign News Agencies Releasing News and Information in China

In order to regulate the release of news and information within the territory of China by a foreign news agency and the subscription of domestic users for news and information from a foreign news agency, enhance a healthy and orderly propagation of news and information, Xinhua News Agency promulgated the “Administrative Measures on a Foreign News Agency Releasing News and Information within the Territory of China” (iSinolaw Reference ID:10019108, hereinafter referred to as the “Measures”) on September 10, 2006. The Measures shall be effective as of the promulgation date.

According to the Measures, regarding the application for releasing news and information within the territory of China, a foreign news agency shall possess the following conditions: with corresponding legitimate qualification in the country (area) where it is located; with good reputation in the field of news and information release industry; with definite business scope; with technical propagation means compatible to the development of its business. Also, the Designated Institution which releases news and information within the territory of China as an agent for a foreign news agency shall possess the following conditions: with legitimate qualification; with good reputation in the business field of news and information release agent; with service network and technical propagation means compatible to its agent business.

Article 11 of the Measures also prescribes that a foreign nes agency shall not release the following information: (1) anything being contrary to the basic principles determined by the “Constitution of the People’s Republic of China”; (2) anything destructing the natioanl unity, sovereignty and territorial integrity of China; (3) anything imperilling the national security, reputation and interests of China; (4) anything being contrary to the religious policies of China, or preaching evil cults or superstitions; (5) inciting ethnic hatred and discrimination, destructing the national unity, encroaching ethnic customs and harming ethnic friendship; (6) disseminating false information, interfering the ecomomic and social order of China, undermining the social stability of China; (7) preaching obscenity, violence or abetting crime; (8) affronting and defaming others, infringing the legitimate interests and rights of others; (9) endangering social morality or the distinct cultural tradition of the Chinese nationality; and (10) other content prohibited by the laws and administrative regulations of China.

According to the Measures, if a foreign news agency releases news and information beyond the business scope ratified by the approval document, solicits clients directly or in a disguished manner to subscribe the news and information, or releases the news and information covering the content listed in Article 11 of these Measures, Xinhua News Agency may impose a warning, demand the rectification within a time limit, suspend the release of the specific content, suspend or disqualify it from releasing so on the basis of the seriousness of the case. Moreover, if domestic users use the news and information from a foreign news agency to an extent beyond the scope under the subscription agreement, transfer the news and information subscribed from a foreign news agency, or use the news and information from a foreign news agency without quoting the source, Xinhua News Agency may impose a warning, demand the rectification within a time limit, order the Designated Institution to terminate or rescind the subscription agreement.

The Measures provide clear definition on the qualification of a foreign news agency and the content of news and information released in China. The promulgation and implementation of the Measures will further regulate the activities of releasing news and information in China by foreign news agencies so that the development of journalism in China will be enhanced.

（一）　新　法　撮　要

新華通訊社進一步規範外國通訊社在中國發佈新聞資訊

為了規範外國通訊社在中國境內發佈新聞資訊和國內用戶訂用外國通訊社新聞資訊，促進新聞資訊健康、有序傳播，新華通訊社於2006年9月10日發佈了《外國通訊社在中國境內發佈新聞資訊管理辦法》（中華法律網之參考編號: 10019108，以下簡稱“《辦法》”），該《辦法》自發佈之日起施行。

根據《辦法》，外國通訊社申請在中國境內發佈新聞資訊，應當具備以下條件：在所在國家（地區）有相應的合法資質；在新聞資訊發佈業務領域有良好信譽；有確定的業務範圍；有與其開展業務相適應的技術傳播手段。指定機構代理外國通訊社在中國境內發佈新聞資訊，應當具備以下條件：有合法資質；在新聞資訊代理發佈業務領域有良好信譽；有開展與其代理業務相適應的服務網路和技術傳播手段。

《辦法》第11條規定，外國通訊社不得發佈以下的資訊：違反《中華人民共和國憲法》確定的基本原則的；破壞中國國家統一、主權和領土完整的；危害中國國家安全和國家榮譽、利益的；違反中國的宗教政策，宣揚邪教、迷信的；煽動民族仇恨、民族歧視，破壞民族團結，侵害民族風俗習慣，傷害民族感情的；散佈虛假資訊，擾亂中國經濟、社會秩序，破壞中國社會穩定的；宣揚淫穢、暴力或者教唆犯罪的；侮辱、誹謗他人，侵害他人合法權益的；危害社會公德或者中華民族優秀文化傳統的；中國法律、行政法規禁止的其他內容。

根據《辦法》，外國通訊社超出批准檔核定的業務範圍發佈新聞資訊，直接或者變相發展新聞資訊用戶，發佈的新聞資訊含有《辦法》第11條所列內容的，新華通訊社視情節給予警告、限期改正、暫停特定內容發佈、暫停或取消發佈資格；國內用戶超出訂用協議範圍使用外國通訊社新聞資訊，轉讓所訂用的外國通訊社新聞資訊，使用外國通訊社新聞資訊不注明來源的，新華通訊社視情節給予警告、限期改正、責令指定機構中止或者解除訂用協議。

《辦法》對外國通訊社的資格，以及在中國所發佈的資訊內容作出了明確的限定，《辦法》的頒佈和實施將會使得外國通訊社在中國發佈資訊的行為得到進一步規範，有利於中國新聞行業的有序發展。
