I. Highlights of New Laws

China Promulgated New Law to Structure the Law on Anti-money Laundering

Money laundering is not only a kind of destruction to the State’s financial management order, but also a new financial platform for other criminal activities. According to the estimation by the International Monetary Fund, the amount of money laundering in China reaches RMB 200 billion to RMB 300 billion annually. The said amount is roughly equals to 2 % of the total economic volume of China. For the purpose of preventing money laundering activities, safeguarding and maintaining financial order, curbing the money laundering crime and its related crimes, China promulgated the “Law of the People’s Republic of China on Anti-money Laundering” (iSinolaw Reference ID: 10020132, hereinafter referred to as the Anti-money Laundering Law) on October 31, 2006.

Article 2 of the Anti-money Laundering Law provides a clear definition on “Anti-money laundering”: the term “anti-money laundering” as referred to in this Law shall mean any conduct to which the relevant measures are adopted in accordance with the provisions of this Law for the purpose of preventing money laundering activities that cover up or conceal the proceeds of drug-related crimes, triad crimes, terrorism, smuggling, corruption and bribery, crime of disrupting financial order, or financial fraud and the source and nature thereof through all means.

The Anti-money laundering Law defines the anti-money laundering duties of financial regulatory institutions under the State Council: to participate in the formulation of rules on anti-money laundering of the financial institutions which are under their supervision and administration, to put forward the requirement for establishing and perfecting anti-money laundering internal control system to their regulated financial institutions, to make a prompt report to the public security organ upon discovery of any transaction which is suspected to be involved in money laundering, and to examine and approve the plan on anti-money laundering internal control system concerning newly-established financial institutions or branches newly set up by financial institutions. No approval shall be granted to the establishment application which does not comply with the provisions of this Law.

Regarding the anti-money laundering obligation of the financial institutions, they shall establish a client identification system, a client identity data and transaction record preserve system, and a large dealings and suspicious transaction report system.

According to the Anti-money laundering Law, If the competent department of anti-money laundering under the State Council or its provincial detached office discovers any suspicious transaction activity for which an investigation and verification is necessary, it may conduct an investigation on the financial institution. The financial institution shall be cooperative. Where the suspicion of money laundering cannot be eliminated upon investigation, it shall be reported immediately to the investigation organ which has the jurisdiction. If the client requires for the transfer of the funds in the account involved to overseas area, the funds may be temporarily frozen for not more than 48 hours upon approval by the person-in-charge of the competent department of anti-money laundering under the State Council.

Moreover, the Anti-money-laundering Law also provides detailed provisions to sanction the competent department of anti-money laundering, other departments or institutions authorized by laws to bear the duty of supervision and administration of anti-money laundering, personnel who engage in anti-money laundering work and the financial institutions for their misfeasance.

The Anti-money Laundering Law shall be effective as of January 1, 2007. The promulgation of the Anti-money Laundering Law is a landmark of the anti-money laundering work. The Law will positively facilitate the prompt detection of the crime, safeguard the order of financial market and curb the crime.

（一）　新　法　撮　要

中國出臺新法律構建反洗錢法律體系

洗錢犯罪不僅破壞國家金融管理秩序，而且為其他犯罪活動提供財政支持，助長新的犯罪。根據國際貨幣基金組織的估計，中國每年洗錢數量高達人民幣2000億～3000億，大體上相當於中國經濟總量的2％左右。為了預防洗錢活動，維護金融秩序，遏制相關犯罪，中國於2006年10月31日頒佈了《中華人民共和國反洗錢法》（中華法律網之參考編號：10020132，以下簡稱“《反洗錢法》”）。

《反洗錢法》第2條明確了“反洗錢”的定義：“本法所稱反洗錢，是指為了預防通過各種方式掩飾、隱瞞毒品犯罪、黑社會性質的組織犯罪、恐怖活動犯罪、走私犯罪、貪污賄賂犯罪、破壞金融管理秩序犯罪、金融詐騙犯罪等犯罪所得及其收益的來源和性質的洗錢活動，依照本法規定採取相關措施的行為。”

《反洗錢法》明確了國務院金融監督管理機構的反洗錢職責：參與制定所監督管理的金融機構反洗錢規章，對所監督管理的金融機構提出按照規定建立健全反洗錢內部控制制度的要求，發現涉嫌洗錢犯罪的交易活動及時向公安機關報告，審查新設金融機構或者金融機構增設分支機搆的反洗錢內部控制制度方案，對於不符合《反洗錢法》規定的設立申請，不予批准。

對於金融機構的反洗錢義務，《反洗錢法》要求，金融機構應當建立客戶身份識別制度，客戶身份資料和交易記錄保存制度和執行大額交易和可疑交易報告制度。

根據《反洗錢法》，國務院反洗錢行政主管部門或者其省一級派出機構發現可疑交易活動，需要調查核實的，可以向金融機構進行調查，金融機構應當予以配合。經調查仍不能排除洗錢嫌疑的，應當立即向有管轄權的偵查機關報案。客戶要求將調查所涉及的帳戶資金轉往境外的，經國務院反洗錢行政主管部門負責人批准，可以採取臨時凍結措施，但臨時凍結不得超過四十八小時。

此外《反洗錢法》還對反洗錢行政主管部門和其他依法負有反洗錢監督管理職責的部門、機構從事反洗錢工作人員和金融機構的違反職責行為的處罰作了詳細的規定。

《反洗錢法》將於2007年1月1日開始實施。《反洗錢法》的頒佈實施，是中國反洗錢工作的一個里程碑，對及時發現洗錢活動、維護金融秩序以及遏制相關犯罪都將起到重要作用。
