The State Council
Promulgated the Regulations ― Legal Basis of Information Network Propagation
As Internet has become more and more common in recent years, a gradual increase in legal disputes relating to Internet is a result therefrom. The copyright problems arising from network information propagation have been drawing concern from more and more people. Having said that, the Copyright Law of China only provides the principle of the copyright for network information without any specific protection rules. It is inevitable to comment that it is a blank area in the Copyright Law. In order to give legal basis for propagation of information network, the Premier, Wen Jiabao, signed an Order No.468 of the State Council on May 18 to promulgate the “Regulations on Protection of Propagation Right in Information Networks” (iSinolaw Reference ID: 10016122, hereinafter referred to as the “Regulations”).
The propagation right in information networks as referred to in these Regulations shall mean the right under which the public is able to select the time and venue to acquire the work, performance or audio or video recording publicly provided by cable or wireless format.
Under the Regulations, unless otherwise prescribed by laws or administrative regulations, if any organizations or individuals provide the work, performance or audio and video recording of others to the public through information network, they shall obtain the permission of the Right Owners and remunerate them.
The Regulations also unequivocally prescribe that without the permission of the Right Owners, no organization or individual shall conduct any of the following acts: (1) intentionally expurgating or altering the electronic information for the rights management of work, performance or audio and video recording that are provided to the public through information networks, unless otherwise the expurgation or alteration is unavoidable due to technical reasons; or (2) providing to the public through information networks the work, performance or audio and video recording from the electronic information for the rights management, which he knowingly or ought to have known to be expurgated or altered without the permission of the Right Owners.
The
Regulations shall be effective as of July 1, 2006. We believe that the
implementation of the “Regulations” will be advantageous to the protection of
propagation right of copyright owners, performers and producers of audio and
video recording in information networks and also beneficial to the creation and
propagation of the works beneficial to socialist spiritual and material
civilization.

（一） 新 法 撮 要
國務院頒布《條例》 信息網絡傳播有法可依
近年來，隨著互聯網的逐步普及，與互聯網有關的法律糾紛也逐漸增多，因傳播網絡信息所引起的著作權問題引起了越來越多的人的重視，然而，由于我國著作權法中只是對網絡信息著作權作了原則性的規定，沒有具體的權利保護規則，這不能不說是我國著作權法的一項空白。爲了使信息網絡的傳播有法可依，總理溫家寶5月18日簽署第468號國務院令，頒布了《信息網絡傳播權保護條例》(中華法律網之參考編號: 10016122；以下簡稱“《條例》”)。
《條例》所稱信息網絡傳播權，是指以有綫或者無綫方式向公衆提供作品、表演或者錄音錄像製品，使公衆可以在其個人選定的時間和地點獲得作品、表演或者錄音錄像製品的權利。
《條例》規定，除法律、行政法規另有規定的外，任何組織或者個人將他人的作品、表演、錄音錄像製品通過信息網絡向公衆提供，應當取得權利人許可，幷支付報酬。
《條例》明確要求，未經權利人許可，任何組織或者個人不得進行下列行爲：(1) 故意删除或者改變通過信息網絡向公衆提供的作品、表演、錄音錄像製品的權利管理電子信息，但由于技術上的原因無法避免删除或者改變的除外；(2) 通過信息網絡向公衆提供明知或者應知未經權利人許可被删除或者改變權利管理電子信息的作品、表演、錄音錄像製品。
《條例》自2006年7月1日起開始實施。相信通過《條例》的實施，有利于保護著作權人、表演者、錄音錄像製作者的信息網絡傳播權，有益于社會主義精神文明、物質文明建設作品的創作和傳播。
