I. Highlights of New Laws

The General Administration of Customs Promulgated the Network Supervision Measures to Regulate Processing Trade Enterprises

In order to regulate the administration of the Customs on processing trade enterprises, the General Administration of Customs promulgated the “Measures of the Customs of the People’s Republic of China on the Network Supervision over Processing Trade Enterprises” on June 14, 2006 (iSinolaw Reference ID: 10016682, hereinafter referred to as the “Measures”).

Under the Measures, a processing trade enterprise to which network supervision is implemented (hereinafter referred to as the “Network Enterprise”) shall satisfy the following conditions: (1) with qualification for processing trade operation; (2) having registered in the Customs; (3) being classified as manufacturing enterprises. However, the Measures shall not apply to the processing trade enterprises within the customs special supervision regions or the bonded supervision sites.

A network enterprise shall present to the competent customs a list of imported raw materials and components required for processing trade and exported finished-products, and their corresponding commodity codes, and shall provide the relevant data for confirming the commodity codes as requested by the Customs if it is necessary.

The Measures also prescribe that the filing system to the competent customs shall be adopted for the subcontracted processing work of the Network Enterprise. The Network Enterprise shall submit the subcontractor of the processing work, name of the goods and turnover quantity to the competent customs for filing before commencing the subcontracting work. The customs may examine and verify the Network Enterprise by means of data verification and on-site verification at the factory. On-site verification at the factory shall include both special verification and stocktaking verification.

The Network Enterprise shall inform the customs before the stocktaking. The Customs may incorporate the enterprise stocktaking into the checking and writing-off. When the customs incorporates the enterprise stocktaking into the checking and writing-off, the customs shall compare the accounting result in the original electronic account with the actual stock in the Network Enterprise, and carry out the following disposal respectively: (1) If the actual stock exceeds the accounting result in the original electronic account, the customs shall adjust the current balance in the original electronic account according to the actual stock; (2) If the actual stock is less than the accounting result in the original electronic account and the Network Enterprise is able to provide proper reasons, the customs shall order the Network Enterprise to apply for domestic sales to dispose the deficiency part; and (3) If the actual stock is less than the accounting result in the original electronic account and the Network Enterprise fails to provide proper reasons, apart from ordering the Network Enterprise to apply for domestic sales to dispose the deficiency part, the customs may also penalize the Network Enterprise according to “Implementation Regulations of the Customs of the People’s Republic of China on Administrative Penalty”.

The Measures shall be effective as of August 1, 2006. The “Measures of the Customs of the People’s Republic of China on Implementing Computer Network Supervision on Processing Trade Enterprises” promulgated by the General Administration of Customs on March 19, 2003 shall be repealed simultaneously. The promulgation and implementation of the Measures will enable the customs to master the real logistics situation of the processing trade enterprises by computer network for the whole course and also have certain degree of facilitation on foreign trade export.

（一）　新　法　撮　要

海關總署發佈聯網監管辦法規範加工貿易企業

為了規範海關對加工貿易企業的管理，中國海關總署於6月14日發佈了《中華人民共和國海關加工貿易企業聯網監管辦法》（中華法律網之參考編號：10016682，以下簡稱“《辦法》”）。

根據《辦法》，實施聯網監管的加工貿易企業（以下簡稱聯網企業）應當具備以下條件：（一）具有加工貿易經營資格；（二）在海關註冊；（三）屬於生產型企業。但是，海關特殊監管區域、保稅監管場所內的加工貿易企業不適用該辦法。

聯網企業應當將開展加工貿易業務所需進口料件、出口成品清單及對應的商品編號報送主管海關，必要時還應當按照海關要求提供確認商品編號所需的相關資料。

《辦法》規定，聯網企業的外發加工實行主管海關備案制。加工貿易企業開展外發加工前應當將外發加工承接企業、貨物名稱和周轉數量向主管海關備案。海關可以採取資料核對和下廠核查等方式對聯網企業進行核查。下廠核查包括專項核查和盤點核查。

聯網企業實施盤點前，應當告知海關；海關可以結合企業盤點實施核查核銷。海關結合企業盤點實施核查核銷時，應當將電子底賬核算結果與聯網企業實際庫存量進行對比，並分別進行以下處理：（一）實際庫存量多於電子底賬核算結果的，海關應當按照實際庫存量調整電子底賬的當期餘額；（二）實際庫存量少於電子底賬核算結果且聯網企業可以提供正當理由的，對短缺的部分，海關應當責令聯網企業申請內銷處理；（三）實際庫存量少於電子底賬核算結果且聯網企業不能提供正當理由的，對短缺的部分，海關除責令聯網企業申請內銷處理外，還可以按照《中華人民共和國海關行政處罰實施條例》對聯網企業予以處罰。

《辦法》自2006年8月1日起實施。2003年3月19日海關總署發佈的《中華人民共和國海關對加工貿易企業實施電腦聯網監管辦法》同時廢止。該《辦法》的頒佈實施，使得海關對企業加工貿易活動的實際物流情況可以實現全程電腦聯網管理，對外貿出口也有一定的促進作用。
