Amendment VI to the Criminal
Law will Definitely Restrain the New White Collar
Crimes
The Twenty-second Session of the Standing Committee of the Tenth National People's Congress of the People's Republic of China adopted the “Amendment (VI) to the Criminal Law of the People’s Republic of China” (iSinolaw Reference ID: 10016920, hereinafter referred to as the Amendment VI to the Criminal Law) on June 29, 2006. The Amendment VI to the Criminal Law focuses on the new types of crimes which have been recently arising from the deepening of the economic system reform and establishing socialist market economy of the State. Thus, the scope of new types of economy crimes in the Criminal Law is enlarged and the penalty to the person liable to the safety production accident becomes heavier.
Under the Amendment VI to the Criminal Law, those who violate the provisions of safety administration in the course of production or operation and an accident involving significant casualty or other serious consequences occur thereby, he shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention. If the circumstances are especially flagrant, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years. If anyone compels other persons to run the hazard or breach the regulations to work, an accident involving significant casualties or other serious consequences are caused thereby, he shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention. If the circumstances are especially flagrant, he shall be sentenced to fixed-term imprisonment of more than five years.
Further, this Amendment to the Criminal Law also prescribes that if anyone who has knowledge that the funds are proceeds obtained from drug-related crimes, triad crimes, terrorism, smuggling, corruption and bribery, crime of disrupting financial order, or financial fraud and gains derived therefrom and commits any of the following acts in order to cover up or conceal the source or nature of the funds, his illegal gain shall be confiscated while he shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention. Moreover, a fine of not less than 5% but not more than 20% of the amount of money laundered shall be imposed instead of the aforesaid sentence or on top of the aforesaid sentence. If the circumstance is serious, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and a fine of not less than 5% but not more than 20% of the amount of money laundered shall also be imposed concurrently.
The Amendment lists out 5 cases: (1) providing fund accounts; (2) providing assistance in converting the property into cash, financial negotiable instruments, or securities; (3) providing assistance in the transfer of capital through transferring accounts or any other form of settlement; (4) providing assistance in remitting funds out of the territory, or (5) covering up or concealing by any other means the nature or source of the criminal proceeds and the gains derived therefrom.
The Amendment VI to the Criminal Law shall be effective as of the promulgation date. The Chinese Government expects that the Amendment VI to the Criminal Law is able to further define the new crimes existing in the aspect of finance and economy and thus to increase the enforceability of the Criminal Law. It will definitely provide effective cure to the new problems arising from the criminal domain of the socialist market economy.

（一） 新 法 撮 要
刑法修正案六的通過必將有效遏制新型經濟犯罪
中華人民共和國第十屆全國人民代表大會常務委員會第二十二次會議於
《刑法修正案六》規定，在生產、作業中違反有關安全管理的規定，因而發生重大傷亡事故或者造成其他嚴重後果的，處三年以下有期徒刑或者拘役；情節特別惡劣的，處三年以上七年以下有期徒刑。強令他人違章冒險作業，因而發生重大傷亡事故或者造成其他嚴重後果的，處五年以下有期徒刑或者拘役；情節特別惡劣的，處五年以上有期徒刑。
刑法修正案規定，明知是毒品犯罪、黑社會性質的組織犯罪、恐怖活動犯罪、走私犯罪、貪污賄賂犯罪、破壞金融管理秩序犯罪、金融詐騙犯罪的所得及其產生的收益，為掩飾、隱瞞其來源和性質，有下列行為之一的，沒收實施以上犯罪的所得及其產生的收益，處5年以下有期徒刑或者拘役，並處或者單處洗錢數額百分之五以上百分之二十以下罰金；情節嚴重的，處5年以上10年以下有期徒刑，並處洗錢數額百分之五以上百分之二十以下罰金。
修正案列舉了5種情形：（一）提供資金賬戶的；（二）協助將財產轉換為現金、金融票據、有價證券的；（三）通過轉賬或者其他結算方式協助資金轉移的；（四）協助將資金匯往境外的；（五）以其他方法掩飾、隱瞞犯罪所得及其收益的來源和性質的。
《刑法修正案六》自頒佈之日起實施。中國政府希望通過刑法修正案六對出現的金融及經濟犯罪的進一步明確，增加了執行中的可操作性，必將有效的規範社會主義建設中刑事領域出現的新問題。
