I. Highlights of New Laws

The Three Departments Including the Ministry of Construction Jointly Issued a Notice to Deter from Cooperative Housing Construction by Means of Illegal Fund Raising

Since the implementation of the reform on town housing system, in order to promptly reduce the shortage of housing for town residents and employees of certain industries, China has released several policies subsequently to encourage employees to improve their living environment through various ways such as purchasing ordinary commercial housing, economic and affordable housing (inclusive of cooperative housing construction by means of fund raising) and leased housing and so on. However, there have been existing problems in recent years where certain units in some areas distribute housing property welfare or develop commodity housing in name of cooperative housing construction by means of fund raising. Therefore, the Ministry of Construction, the Ministry of Supervision and the Ministry of Land and Resources jointly have issued the “Notice on Deterring from Cooperative Housing Construction by Means of Illegal Fund Raising” (iSinolaw Reference ID: 10018443, hereinafter referred to as the “Notice”) to define strict provisions on examination and approval and usage of cooperative housing construction by means of fund raising.

Under the Notice, all the examination and approval for the projects of the organs under the Communist Party or the government concerning cooperative housing construction by means of fund raising shall be suspended as of the date of handing down of the Notice. For those projects of cooperative housing construction by means of fund raising which have been approved without the construction permit obtained, they shall be re-examined by the administrative authority of real estate (housing reform) jointly with relevant authorities. The construction of those which do not conform to the “Measures for Administration of Economic and Affordable Housing” and the policy of housing reform shall not commence as if they are the projects of cooperative housing construction by means of fund raising. For those projects of cooperative housing construction by means of fund raising, which have already been commenced, the administrative authority of real estate (housing reform) shall re-examine the materials to be supplied, standards for areas and standard for fund raising of the projects jointly with the relevant authorities. For those employees whose housing areas have already reached the local prescribed standards so that they fail to conform to the conditions for participating in the cooperative housing construction by means of fund raising, they shall be disqualified. For those employees who conform to the conditions for participating in cooperative housing construction by means of fund raising but their housing areas (the housing areas according to which the preferential policy of the government has already been enjoyed and new areas of the cooperative housing construction by means of fund raising shall be consolidated in calculation) exceed the local prescribed standards, they shall be disposed of according to the local measures for disposal of housing areas exceeding the standards. Where the units which violate the regulations and provide subsidy of housing construction by means of fund raising for their employees, the units shall be ordered to take back the subsidy.

The Notice requires that the cooperative housing construction by means of fund raising shall comply with the overall planning of land use and the urban planning, shall be listed in the local construction plan of economic and affordable housing of the year and the annual land use plan. The examination on the construction standards, preferential policy and materials to be supplied thereof shall strictly accord to the relevant provisions concerning economic and affordable housing. The completed housing shall not be sold to those other than the examined supply target.

For those who approve or carry out the cooperative housing construction by means of fund raising, which is contrary to the regulations, the person assuming the relevant responsibility shall be liable shall be seriously investigated for his liability. For those which makes use of their power or influence to carry out cooperative housing construction by means of fund raising in order to seek housing benefit beyond the limit set by the standard for the employees of their own unit, the relevant unit leaders shall be investigated for liability. For those who conduct commodity housing development in the name of cooperative housing construction by means of fund raising and sell those completed housing externally, the illegal proceeds shall be confiscated, and the relevant liable persons shall be severely punished. If a crime is constituted, the relevant liable persons shall be transferred to judicial authorities for the investigation for their criminal liability.

The promulgation and implementation of this Notice will definitely produce inhibitive effect in respect of cooperative housing construction by means of illegal fund raising. Moreover, it will make a positive impact regarding further stabilization and regulation of the real estate market in China.

（一）　新　法　撮　要

建設部等三部委聯合發佈通知制止違規集資合作建房

實行城鎮住房制度改革後，為儘快改善城鎮居民和一些行業職工住房緊張的狀況，中國相繼出臺了一些政策，鼓勵職工通過購買普通商品住房、經濟適用住房（含集資合作建房），租賃住房等多種方式改善居住條件。但是，近年來，一些地區出現部分單位以集資合作建房名義，變相搞住房實物福利分配或商品房開發等問題。為此，建設部，監察部，國土資源部聯合發佈了《關於制止違規集資合作建房的通知》（中華法律網之參考編號：10018443，以下簡稱“《通知》”），對集資合作建房的審批和使用都作出了嚴格的規定。

《通知》規定，自該通知下發之日起，一律停止審批黨政機關集資合作建房專案。對於已審批但未取得施工許可證的集資合作建房專案，房地產管理（房改）部門要會同有關部門重新審查，不符合《經濟適用住房管理辦法》和房改政策的，不得按集資合作建房專案開工建設；對於已經開工建設的集資合作建房專案，房地產管理（房改）部門要會同有關部門重新審查專案供應物件、面積標準和集資款標準。對住房面積已經達到當地規定標準等不符合參加集資合作建房條件的職工，取消其資格。對雖然符合參加集資合作建房條件，但住房面積（以前已享受政府優惠政策的住房面積和新參加集資合作建房的面積合併計算）超過當地規定的，按照當地住房面積超標處理辦法執行。對單位違規向職工提供集資建房補貼的，責令收回。

《通知》要求，集資合作建房必須符合土地利用總體規劃和城市規劃，列入當地本年度經濟適用住房建設計畫和年度土地利用計畫，其建設標準、優惠政策、供應物件的審核等要嚴格按照經濟適用住房的有關規定執行。建成的住房不得在經審核的供應對象之外銷售。

對於違反規定批准或實施集資合作建房的，要嚴肅追究有關責任人的責任。對利用職權及其影響搞集資合作建房，超標準為本單位職工牟取住房利益的，要追究有關單位領導的責任。以集資合作建房名義搞商品房開發，對外銷售集資合作建成的住房的，要沒收非法所得，並從嚴處理有關責任人；構成犯罪的，移送司法機關追究刑事責任。

《通知》的頒佈實施，將對違規的集資合作建房起到抑制作用，對進一步穩定和規範中國的房地產市場也會起到積極的作用。
